I just received an email from USCIS saying that my I-140 has been denied. I touched base with the attorney & she has not yet received any documentation from USCIS. This has been the 1st change in my status since Aug 07. My case is pending at TSC.
Does anyone know if this is a fairly common occurance for USCIS to deny I-140 without an RFE? Any advise on what to do next?

I know this is irrelevant in a way but see it from a different angle for one moment. There is no other forum where you can get any information about these H1 employers who are playing games using retrogression. This is the only forum where most of the people on H1 are related to some desi consulting company and can share their experiences which would help other people who are in huge pain due to the unfair practices of their existing employers.
I would recommend the administrators to create a separate area on this forum where people can share these experiences and find genuine employers.

It amazes me how united and organized ILLEGAL immigrants are. I think this is good thing. This will definitely weed out the fraud cases and maybe free up some visa numbers. If your AC-21 portability is genuine you have nothing to fear. Let them investigate as much as they want.

My Labor PD is Jan 2003, was approved on Sept 25th. Got it last week. It is very random process I guess. Can't tell how long you have to wait knowing so many people behind us got their approvals before us. Any inquiry didn't work. I just gave up and waited.

So I've been out of school for just about 3 weeks now and haven't done much shooting lately. Took the family up into the mountains today and grabbed the camera and a 50mm lens...nothing else (including the spare battery that I'd need soon after :mad: ). Anyway, I couldn't get a decent shot of anything that I "saw". Very disappointing to say the least.
Now, This is the best of about 10 shots I was able to take before I needed the aforementioned spare battery. My fault, I didn't check the charge level and I forgot the spare....whoops.
Anyway, while walking through the woods, this stump caught my eye. I'm not entirely sure why, but it did. Now here I am looking at a photo of a stump. It's a nice enough stump, I suppose and might be nicer if that branch to the right wasn't there but I'm curious to see if I'm going crazy or if there's anything actually worthwhile in this shot (something more than a snapshot- but not by much.)

I am worried about my employer. Given the fact about I-485 apps and the last few days of labor in the previous month I have doubts about my employer. He is a very mean and hopeless desi employer and I am worried if he sold out my labor to some high bidder. is there any way i can find out if my labor is still infact in my name. any thoughts

afaik there is no impact on GC... EXCEPT: if there is an RFE, you have to prove beyond doubt to uscis that you have a full time job and your job duties are "Same or similar" to what is in your labor application... however, if you asked me, from a tax and liability perspective, i would recommend going for llc/s-corp/c-corp (based on your situation) instead of 1099... even 1099 can be used for good tax benefits but is not that great from a liability perspective... having said that, if you are into software development, it is likely that you will be asked to buy liability insurance... so, it all depends on your situation...

Hi,
I got a RFE on my 485 to submit all the W-2 and 1040. I do not have one of my W-2 form which my previous employer never provided me.
I want to write a covering letter regarding non availability of that W2. I have email proofs of my requests to the employer regarding the W2. I also want to attach a copy of the letter which IRS has sent me regarding the complaint I have filed regarding the same.
Could any of you guys help me with a format of the letter and also what all I need to include in that letter. I also need to know to whom should this letter be addressed.

I guess Wacom advertises their tablets more vigorously than Genius? Who knows... have you compared Genius and Wacom side by side and discovered that Genius is far superior? Personally, I selected Wacom because it's the only brand that isn't obscure and I've read a number of positive things about Wacom. It's pricey but a good investment. My first Graphire paid for itself in no time and even helped me purchase my Intuos 2.
