Just got a word from our attorney that my case was approved on 09/08/2010. In my case USCIS did not update the website with the approved status! Not even a soft LUD.... I don't know their operating standard!

Thanks for many of you reading my post! So now you know even with out USCIS website update there is a chance that ones case would be approved.

Lesson learnt: Always check with attorney!

Now on to the final hurdle! I-485.

Hi, Is there anybody in this forum who has filed G-28 for self? Can somebody please advise what to fill? I am going thru the G-28 form right now, it has the following option:
1. I am an attorney...
2. I am acredited representative of religious, charitable trust....
3. I am associated with -------- the attorney of record previously filed a notice of appearance...(in this case, please check 1 or 2 as appropriate)
4. Others (Explain fully).
I guess if we have to file for self, we need to check others.
Can someone please advise what to write in the explanation? Also, does USCIS acknowledge the change of record or at least the receipt of G-28? Can this be filed even before sending AC21 letter? Is there anyway the existing lawyer/company will know about this? Thanks in advance for the reply.

If Skill Bill passes eventually, won't EB2 be beneficial over EB3.

I used my EB2 (jan 2006) over EB3 (March 2005)

SKIL doesnt look at EB2 or EB3, only whether you have a US graduate degree in STEM.

We did check that. What we wanted was I.T project manager, but it got classified as CIS Manager.

We cannot change the job from Project manager to Computer systems analysts.

I am going to be promoted as Project manager, so we need to get a PM role.

As long as your H1-B application is still being processed, you should be IN STATUS.

For your passport renewal, you can write a cover letter to the Indian Embassy explaining that your visa extension is being processed and provide them a copy of the acknowledgment notice. That should be enough for establishing your legal presence for passport purposes.

I had my FP done at San Jose ASC and It took us around 15 min for the entire process of filling the forms,waiting to be called for FP and doing the actual FP.

The lady asked me to sign on an electronic pad(some people reported that they were asked to write their full name and sign at the bottom) which I did and she gave us some feedback forms to fill out and drop in the suggestion box.

It was easy for me to locate the ASC because i used to commute by Charcot drive to take 87 on my way back home from my old office :)

A friend of mine went without the receipt. Only his wife had the receipt. They printed his receipt right there... Even tho his appnt was a week later they did his FP the same day... he had no problems with the security guard... I guess its just ur luck!

Need experties if any one have this situation.

Labor - EB2
PD - Sept , 2006
I-140 Approved

Employer : Y (Current)
Labor : EB3
PD : May 9 2003I
1-140 Approved
I-485 : Pending

Q : Is it possible to change/port category EB3 - EB2 and keeping the EB3 Date of 2003
Q : How is the apeal done considering I-485 is already filled.
My Attorney says better to file fresh EB2 with current company.

Please reply with your experties or if being deal with this one.

Background:

EB-2 India
Employment based petition
PD: Feb 2003
Labor approved (after a long wait at Backlog reduction Ctr)
I-140 filed
Waiting for PD to be current to be eligible to file I-485

To avoid further delays and have the necessary paperwork on-hand ready to file I-485 petition when PD becomes current, I had the following questions for the folks on this forum who have filed I-485 or are knowledgeable about the paperwork requirements:

1) Birth Certificate: I have my original birth certificate but it is not in English.
a. I have a translated notarized version in English from India. Will this suffice?
b. If not, can a birth certificate issued by the Indian Consulate General suffice?
c. Also, is this birth certificate required for spouse too if her name is added to I-485 petition?

2) Police clearance: I know that one has to go thru the FBI name check for US clearance and this is done by processing center after filing of I-485 petition.
a. Do I need to have a police clearance from India?
b. If so, can a Police clearance certificate from Indian Consulate General suffice?
c. Also, is police clearance certificate required for spouse if her name is added to I-485 petition?

3) Medical: I have the list of approved Doctor�s in my geographical area. However, I do not have my inoculation records. Hence, I believe the Doctor will administer the shots again.
a. How long does the approved Dr. to finalize the tests and administer the shots? Is this a 1 day or week(s) process before the Dr. hands over the sealed medical forms back?
b. How long is the medical test valid? (Is it valid for 1 month, 6 months etc)

4) Additional documentation: Is there any other documentation, not stated above, that has a long lead time that I can start to accumulate now?

Your highlighted sentence is again for "grant the extension".
We are talking about "invalidation" of a granted extension.

Those are two different things.

And NO. the memo doesnt talk about that.

There is no specific law or interpretation available till today for "invalidation of an already granted extention" based on approved I140, even if the I140 itself gets revoked in future.

Please read before giving your opinions: as per memo not my words:

USCIS is required to grant the extension of stay pursuant to �106(a) of AC21, in one-year increments, until such time as a final decision has been made to:
A. Deny the application for labor certification, or, if the labor certification is approved, to deny the EB immigrant petition that was filed pursuant to the approved labor certification;
B. Deny the EB immigrant petition, or
C. Grant or deny the alien�s application for an immigrant visa or for adjustment of status.

The operative words here being "UNTIL SUCH TIME" - which if I am not wrong means when the decision is reached.....so you DO NOT HAVE A VALID H1B IF 485 IS DENIED.

2.H1B Extension, I94 Expired, H1B transfer before H1B extension. When can I start working with new employer ..after getting receipt or after getting approval.?

I am in the same boat, changed my mind to apply for AP in the last minute and mailed my application on Aug 16th, USPS messed it up and couldn't deliver it on Aug 17th, tried delivering it on 18th but didnt since offices were closed finally delivered it on 20th.

Now my AP application got rejected citing that I should have applied with new fee of $305 starting July 30th.

What is confusing is where does it says post marked by Aug 17th? I thought USCIS had to receive it by Aug 17th.

write the following on the envlope using marker
DO NOT OPEN IN THE MAIL ROOM

and address the package to director of the service center also include the evidance that you have applied when the visa bulliten is current
